Question 18: Marbury v. Madison

It was the Marbury v. Madison decision in the case that the Supreme Court was able to establish

the judicial review principle. The ruling involved the part of the judicial review stating the

unconstitutionality of the Supreme Court issuing a mandamus to compel the release of some

commissions. The case formeda basisfor the establishmentofthe precedentthata court might

term a Congress passed the law asbeing unconstitutional. Although the principle of judicial

review was not necessary for several decades in the US, the ruling established a pillar for the

checks and balances of the American laws and constitution (Ray, 2016). The ruling was also

important for theCourt in the formation andspread ofthe concept offederalism. The federal

government holds the supreme law of the state and therefore has the power of the judicial

review. Today, the US Supreme court has the power, authority, andright to ruleagainst rules that

do not meet the constitutional standards in line with the Marshall ruling.
